GDPR Compliance

General Data Protection Regulation Overview

Our Role Under GDPR

The General Data Protection Regulation (GDPR) distinguishes between organizations that process personal data for their own purposes (known as "controllers") and organizations that process personal data on behalf of other organizations (known as "processors"). Arcus Foundry LLC acts as both a controller and a processor, depending on the context in which personal data is processed.

As a Controller

When you visit our website, create an account, or otherwise interact with our Services directly, Arcus Foundry LLC acts as a controller of your personal data. This means we determine the purposes and means of processing your personal data and are responsible for complying with applicable data protection laws.

As a Processor

When our customers use Sparkforge to manage their own customer relationships, Arcus Foundry LLC acts as a processor of the personal data that our customers' end users provide. In this capacity, we process personal data on behalf of and under the instructions of our customers, who act as the controllers. Our customers are responsible for ensuring they have a valid legal basis for collecting and processing their end users' personal data.

Legal Basis for Processing

Under GDPR, we must have a valid legal basis for processing personal data. The legal bases we rely on include:

  • Consent: Where you have given clear consent for us to process your personal data for a specific purpose. You have the right to withdraw consent at any time.
  • Contract: Where the processing is necessary for a contract we have with you, or because you have asked us to take specific steps before entering into a contract.
  • Legal Obligation: Where the processing is necessary for us to comply with the law (not including contractual obligations).
  • Legitimate Interests: Where the processing is necessary for our legitimate interests or the legitimate interests of a third party, unless there is a good reason to protect your personal data which overrides those legitimate interests.

Data Subject Rights

Under the GDPR, data subjects (individuals whose personal data is processed) have the following rights:

  • Right to be Informed: You have the right to be informed about the collection and use of your personal data. This Privacy Policy serves as our primary method of providing this information.
  • Right of Access: You have the right to request access to your personal data and supplementary information. This allows you to be aware of and verify the lawfulness of the processing.
  • Right to Rectification: You have the right to have inaccurate personal data rectified, or completed if it is incomplete.
  • Right to Erasure: You have the right to request the deletion or removal of personal data where there is no compelling reason for its continued processing.
  • Right to Restrict Processing: You have the right to request the restriction or suppression of your personal data. When processing is restricted, we are permitted to store the personal data but not further process it.
  • Right to Data Portability: You have the right to obtain and reuse your personal data for your own purposes across different services. This allows you to move, copy, or transfer personal data easily from one IT environment to another.
  • Right to Object: You have the right to object to processing based on legitimate interests or the performance of a task in the public interest, direct marketing, and processing for purposes of scientific or historical research and statistics.
  • Rights Related to Automated Decision-Making and Profiling: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

To exercise any of these rights, please contact us at hello@arcusfoundry.com. We will respond to your request within one month. In certain circumstances, we may extend this period by two further months where necessary, taking into account the complexity and number of the requests.

Data Transfers

As Arcus Foundry LLC is based in the United States, any personal data we collect from individuals in the EEA, UK, or Switzerland will be transferred to the United States. We ensure that appropriate safeguards are in place for such transfers, including:

  • EU-U.S. Data Privacy Framework: Arcus Foundry LLC is certified under the EU-U.S. Data Privacy Framework, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework, ensuring that personal data transferred from the EEA, UK, and Switzerland to the U.S. is protected by adequate safeguards.
  • Standard Contractual Clauses: Where applicable, we use Standard Contractual Clauses approved by the European Commission to ensure adequate protection for personal data transferred outside the EEA.
  • Data Processing Agreements: We enter into data processing agreements with our customers and service providers that include appropriate safeguards for cross-border data transfers.

Security Measures

In compliance with GDPR requirements, we implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including:

  • Encryption of personal data in transit (TLS/SSL) and at rest
  • The ability to ensure the ongoing confidentiality, integrity, availability, and resilience of processing systems and services
  • The ability to restore the availability and access to personal data in a timely manner in the event of a physical or technical incident

  • Regular employee training on data protection and information security
  • Access controls limiting access to personal data on a need-to-know basis
  • Incident response procedures for detecting, reporting, and investigating personal data breaches

  • Privacy by Design: We have integrated data protection into our development processes and business practices, ensuring that privacy is considered at every stage of product development and service delivery.
  • Data Protection Impact Assessments: We conduct Data Protection Impact Assessments (DPIAs) for processing activities that are likely to result in a high risk to the rights and freedoms of individuals.
  • Vendor Management: We have implemented a vendor management program to ensure that our third-party service providers comply with GDPR requirements and provide adequate protection for personal data.
  • Breach Notification: We have established procedures for detecting, reporting, and investigating personal data breaches. In the event of a breach that is likely to result in a risk to individuals' rights and freedoms, we will notify the relevant supervisory authority within 72 hours and affected individuals without undue delay.
  • Data Retention: We have implemented data retention policies to ensure that personal data is not kept for longer than necessary for the purposes for which it is processed.
  • Employee Training: We provide regular training to our employees on data protection and GDPR compliance.
  • Data Subject Requests: We have established processes for handling data subject requests, including requests for access, rectification, erasure, restriction of processing, data portability, and objection.
